Loyalty Program Membership and Terms of Use

BLUEMINT LOYALTY PROGRAM MEMBERSHIP AND TERMS OF USE

The Bluemint Loyalty Program Membership and Usage Terms and Conditions are designed to regulate the rules governing the use of Loyalty Program membership and the procedures and principles for Loyalty Program membership. Loyalty Program membership refers to a program provided by Bluemint Mağazacılık Anonim Şirketi (“Bluemint” and/or “the Company”) that offers additional benefits under the conditions stated below.

Bluemint Loyalty Program Membership

1.1. Bluemint Loyalty Program membership can be created at Bluemint stores, websites, and certain areas provided by the Company.

1.2. The Bluemint Loyalty Program membership process begins with acceptance of the Bluemint Loyalty Program Membership and Usage Terms and Conditions, acknowledgment of reading and understanding of the information text regarding the processing of your personal data within the scope of the Bluemint Loyalty Program, provision of explicit consent for the processing of personal data if necessary, and completion of the necessary verification/activation processes.

1.3. You cannot benefit from the privileges offered under the Bluemint Loyalty Program until you begin membership. The company cannot be held responsible for any benefits that may be lost or losses that may be incurred due to the inability to complete the membership process for any reason.

Membership is created based on the Member's verbal/confirmed statement and/or by entering a verification code sent to their phone during a purchase at the store.

Membership is free and entirely optional, and members have the right to cancel their membership at any time.

1.6. The member acknowledges that the information provided during the creation of their Bluemint Loyalty Program membership is accurate and up-to-date.

1.7. The privileges of the Bluemint Loyalty Program are valid for purchases made after the first purchase following membership registration. These benefits cannot be used for the first purchase.

Benefits of the Bluemint Loyalty Program

2.1. Only individuals who are 18 years of age or older can become members of the Bluemint Loyalty Program. The program is not intended for legal entities, and individual membership will not be accepted under any circumstances.

2.2. Bluemint Loyalty Program membership is personal and may not be used for any commercial purpose whatsoever. The member acknowledges, declares, and undertakes that they will not share their username and/or password with third parties, will not allow others to use it, and will be solely responsible for maintaining the confidentiality of this information. If it is determined that membership information has been used by unauthorized persons or that the program has been misused, Bluemint reserves the right to terminate the relevant membership, cancel earned points and rights, and take other necessary measures.

2.3. Points earned from purchases made in stores can be used on your next purchase. However, points cannot be earned on purchases of discounted or promotional items during sales periods (such as Black Friday).

2.4. Earned points are valid for one year (1 year) from the date of earning them. Points not used after this one-year period will be automatically deleted and will not grant the member any rights.

2.5. In case of a return of the purchase, the points earned from that purchase will be deducted.

2.6. Points earned or additional benefits provided under membership cannot be converted into cash or used as a substitute for cash in any way.

2.7. The Bluemint Loyalty Program is valid only in stores designated by Bluemint. Bluemint is free to determine the stores where the program is valid. The program is not valid in stores abroad or at airports. The types and terms of application of Bluemint Loyalty Program campaigns may vary between stores. Bluemint reserves the right to change these terms. Bluemint has the right to change the content, conditions, and scope of loyalty program campaigns at any time.

Bluemint Loyalty Program General Terms and Conditions

3.1. Privileges granted under the Bluemint Loyalty Program may not be used for commercial purposes. Commercial use includes bulk purchases for resale, purchases made on behalf of businesses, or similar commercial transactions.

3.2. Bluemint Loyalty Program membership is personal; it cannot be used by another person or transferred to another person.

3.3. To continue benefiting from the Bluemint Loyalty Program, Bluemint may request that you update and verify your information.

3.4. The Bluemint Loyalty Program accepts no responsibility for any interruption, error, negligence, disruption, deletion, loss, delay in processing or communication, computer virus, or communication failure resulting from breach of contract, tort, negligence, or other causes.

3.5. Updating the amounts included in the Bluemint Loyalty Program may require additional time or processing in some cases. The Company shall not be liable for any damages or losses arising from such delays.

3.6. If a user of the Bluemint Loyalty Program loses access or use of the program, they must immediately inform the Company. The Company shall not be liable for any damages or losses arising from actions taken by the Company due to third-party use or commercial use of the program.

3.7. The Bluemint Loyalty Program is not a separate e-commerce system, and none of its existing advantages constitute electronic money or a substitute for electronic money. In the event of any changes to the structure or operation of the Bluemint Loyalty Program, additional permissions may be requested from the Bluemint Loyalty Program user.

3.8. The information text and explicit consent text regarding the personal data to be processed within the scope of the Bluemint Loyalty Program can always be accessed and read on the pages related to the Bluemint Loyalty Program. Bluemint may require explicit consent for the use of the Loyalty Program; this does not constitute a condition for service. Company customers can always benefit from the Company's products and services even without taking advantage of the benefits of the Bluemint Loyalty Program.

3.9. The Bluemint Loyalty Programme brand, logo, and all audio, visual, and written content associated with the Bluemint Loyalty Programme belong to their respective owners unless otherwise stated, and their unlawful use is prohibited. Use of the Bluemint Loyalty Programme shall in no way be construed as permission to use any intellectual property rights related to the Bluemint Loyalty Programme.

Termination of Bluemint Loyalty Program Membership

4.1. Bluemint Loyalty Program users are informed that their purchases and use of the Bluemint Loyalty Program may be monitored based on criteria such as purchase frequency, amount, and billing information. If the Company determines that the discount rate and privileges defined within the Bluemint Loyalty Program are being used for commercial purposes or by third parties other than the person whose information was provided during membership registration, the Bluemint Loyalty Program membership may be unilaterally terminated.

4.2. The Company may refuse to provide Bluemint Loyalty Program membership or terminate Bluemint Loyalty Program membership without giving any reason, and therefore no claim for any damages may be made against the Company.

4.3. If the Company receives information that the information provided during Bluemint Loyalty Program membership is incorrect, belongs to a third party, or is not accurate or up-to-date, it may suspend or cancel the benefits of the Bluemint Loyalty Program and request that membership information be updated and/or verified in order to redefine the benefits.

4.4. Bluemint Loyalty Program users can terminate their Bluemint Loyalty Program usage by contacting the Company directly.

4.5. If Bluemint Loyalty Program membership is terminated for any reason, the benefits of the Bluemint Loyalty Program will be forfeited and will no longer be available. The Company shall not be liable for any damages or losses arising from the loss and/or termination of benefits.

Contract Amendments

5.1. The Company reserves the right to unilaterally terminate, amend, or renew the Bluemint Loyalty Program and the rights provided.

5.2. The company may reject Bluemint Loyalty Program membership applications or modify membership terms for any reason.

5.3. Changes will be deemed accepted if the customer does not request otherwise within 4 weeks of the changes being notified by the Company or published in the relevant areas, or if purchases are made using the Bluemint Loyalty Program or membership in the Bluemint Loyalty Program is continued.

Notification

Notifications regarding the Bluemint Loyalty Program may be made through all methods including push notifications, calls, SMS, and email. The Bluemint Loyalty Program user acknowledges that the email address and mobile phone number provided during registration may be used as the notification channel for their application membership associated with the Bluemint Loyalty Program.
